Are the leaders of the Gerua Brigade who occupied Bengal accused of gangraping a Bengali woman? The case was first filed in the Alipur District Court of Kolkata. In that case, the victim sought permission to file a gang-rape complaint against 3 BJP leaders as an FIR.
But the Alipore court rejected that application. Then the victim filed a case in Calcutta High Court. In that case, the High Court allowed the FIR to be filed against only 3 BJP leaders. 3 BJP leaders went to the Supreme Court seeking a stay on that verdict. But on this day they were shocked there. The apex court of the country sent the case back to the Alipore court. Also ordered that the case should be re-heard and considered. The Alipore court magistrate will decide whether to file an FIR against the 3 BJP leaders. And these 3 leaders are Kailas Vijayvargiya, Pradeep Joshi, and Jishnu Bose. Among them, Pradeep was later dismissed by the Bengal BJP leadership. And Jishnu Bose is the top RSS leader in the state. Allegedly, after that incident, the woman and her family started receiving death threats. In this incident, two complaints were filed in Sarshuna in 2019 and Bolpur in 2020. The woman approached the Alipore lower court in 2020. This time the same case returned from the Supreme Court to the lower court. On that day, the division bench headed by Chief Justice MR Shah sent the case back to the Alipore court without giving any relief to Kailas. A section of the legal community is of the view that since the Calcutta High Court had already allowed the FIR of gang rape against 3 BJP leaders including Kailash and the Supreme Court had not granted any stay on the order, the Alipore court will follow suit. i.e. will allow the filing of FIR against gang-rape.
