Anubrata must stay in Tihar, Delhi court rejects appeal to return him to Asansol Jail

Anubrata Mandal (Kesto) should stay in Tihar Jail. Trinamool district president of Birbhum, arrested in the cow smuggling case, had appealed to Delhi's Rouse Avenue court to return him to Asansol jail from Tihar. Judge Raghuveer Singh dismissed Anubrata's plea on Thursday.

On May 1, a long hearing was held in the Delhi court on the basis of Anubrata's application. However, the judge did not give any order that day. As Anubrata's jail term expired, he was produced in court on Thursday. The judge ruled on the plea of transfer to Asansol Jail before the hearing in that regard. He said, there is no basis for Anubrata's complaint. No durability. Following the demand of the Enforcement Directorate (ED), the judge ordered the Trinamool leader to be kept in Tihar.

Anubrata has been in Tihar for two weeks of interrogation after the ED kept him in their custody in Delhi. His lawyer argued in court that there is no ED case against Anubrata in Delhi. A case against Anubrata is pending in the special CBI court in Asansol. So let him be sent back there. After the ED's custody, the investigators again went to Tihar and did not record Anubrata's statement. Even after 60 days, ED has not filed the charge sheet. If the ED needs it again or the trial starts in Delhi, he can be brought back to Tihar Jail.

ED strongly objected to this plea of Anubrata. The central agency's counsel argued that if the ED files the chargesheet in the Delhi court, then it will take 6 to 8 months to bring Anuvrata back from Asansol. His question is, how will the accused decide, which jail will he stay in? Anubrata is now under Rouse Avenue Court. ED lawyer Nitesh Rana said to Anubrata, 'Now consider Tihar Jail as your home for the next 3-4 years.' Accepting the ED's argument, the court on Thursday ordered to keep Anubrata in Tihar.
